my ex boyfriend is saying that he is going to file a report for identity theft because I used a credit card in his name.  this has been 3 yrs ago.  can he do that

In Alabama you commit identity theft when, with the intent to defraud and without the victim’s permission, you do any of the following:

obtain, record, or access any type of identifying information that can help you access financial resources, 

obtain identifying documents, or obtain any kind of benefit

use the victim’s identifying information to obtain goods or services

obtain identifying documents in the victim’s name, or

use the victim’s identifying information to obtain employment.

In this case, the ex boyfriend is therefore allowed by law to sue the defendant  if only she used his credit card for financial benefits without the permission from the ex boyfriend .
