Disparate Treatment

"Disparate Treatment Title VII prohibits employers from treating applicants or employees differently because of their membership in a protected class. The central issue is whether the employer's actions were motivated by discriminatory intent, which may be proved by either direct or circumstantial evidence." (Title VII) A protected class is those employees over 40 years of age.

In regard to the number of plaintiffs, this suit can have just one plaintiff. The intent would be to fire a worker due to age
