For an individual going to prison, it means that their rights have to be curtailed but that
does not mean that inmates have no human rights. With inclusivity of the most hardened
criminals have their constitutionally protected rights which cannot be violated in any way.
Inmate’s rights vary with where they are incarcerated and also the stage they are in their criminal
process. The stages include those are jailed waiting for trials it is their right to be housed in a
humane facility and cannot be punished for whatever reason because they are not yet proven
guilty to the point of getting punished. Cruel and unusual punishments are not allowed since
every inmate has the right to be free from inhuman treatments. Those treatments include, burning
alive, public dissection, beheading, disemboweling, quartering and drawing.
It was as well left open by the Supreme Court that any other punishments today to be
considered cruel or inhuman would not be tolerated. Violation of individual’s dignity might be
considered as well cruel and unusual. They have rights against sexual arrestments from both the
fellow inmates and either from the prison personnel. If such incidences occur to inmates the
government has individuals like government officials, administrators and the court has held
guards for that as well. The above personnel is answerable in case of occurrences of sexual
arrestments or related violating crimes. In case of happenings of such crimes then criminal
sanctions and civil penalties are therefore inflicted. The court reviews the inmate’s treatments
case by case occasionally. Inmates as well have the rights to complain about access to the courts
and also about prison conditions. Complains are done by voicing to either the courts or the prison
officials or to both.

After inmates complain of prison conditions then they might be placed in solitary
confinement and as well receive a civil judgment against prison officials. Inmates with
disabilities are entitled to special and reasonable accommodation in American act due to their
