The Governments Control on Sale of Recreational and/or Medicinal Marijuana in
the State of California and whether it is Constitutional
The State of California allowed for the medical use of marijuana back in 1996 following
the passing of Proposition 215 by voters making it the first state to do so. Since then, there are
more than 30 States that have enacted similar laws together with the District of Columbia, Guam,
and Puerto Rico (NCSL, 2018). In total, there are 33 States together with the District of
Columbia, Guam, and Puerto Rico that have approved programs for comprehensive public
medical marijuana (NCSL, 2018). Following the enactment of Proposition 215 by the State of
California, the Institute of Medicine went on to carry out more investigation on the potential use
of marijuana and it demonstrated that there was a potential therapeutic importance for the
cannabinoid drugs and specifically THC for use as a pain reliever, in the control of nausea, in the
stimulation of individuals appetite (Institute of Medicine, 1999). Nevertheless, the drug has also
been found to have some psychological effects which tend to counter the influences that it would
have as a therapeutic drug.
At the Federal level, marijuana is still considered as a substance with a potential of high
dependencies and one that has no medical use and is classified under Schedule 1 of the
Controlled Substances Act which makes the distribution of marijuana to be a federal crime.
