Henschel v Clare County Road Commission
Question One
The legal issue here is that Clare County Road Commission (CCRC) discriminated
Henschel because of his disability. Henschel worked at CCRC as an excavator operator until he
got involved in a motorcycle accident which resulted in one of his leg getting amputated. He took
time off work to recover, and during that time, CCRC hired a temporary excavator operator who
was to serve in that position until Henschel returned to work. In place of the amputated leg, he
decided to fit a prosthetic leg which would help him in moving around and completing other tasks.
Sadly, Henschel got terminated from work because they deemed him unable to perform his duties
as the excavator operator, mainly the function of transporting the excavator to the work site. He
went to court and lost and decided to appeal. The appeal court reversed the ruling of the district
court citing that hauling the excavator was not an essential function of the excavator operator.
CCRC discriminated upon Henschel because of his disability which goes against ADA stipulates
that individuals with disabilities should not be discriminated upon ("Americans with Disabilities
Act: A guide for people with disabilities seeking employment," 2007)
