3. The dual court system is divided between the federal court system and our state court system which is comprised of 50 individual state court systems. Federal U.S. Supreme Court is the highest and oldest court and focuses on constitutional issues or issues of legal importance. Federal U.S. Court of Appeals reviews some criminal cases, but mostly reviews cases originating from administrative agencies. Federal U.S. District Court is primarily the federal criminal court, and some jurisdiction over state courts. State supreme court mainly decides cases surrounding the state constitution. Some states have an intermediate court of appeals to review lower court decision. States also have trial courts that may be referred to as circuit or district courts.

Police brutality is one of the topics that have recently been very common in the media of
the United States of America. Brutality against African Americans has especially been spoken
about very commonly due to the various cases of police brutality and killings of African
Americans by the police across the states of the United States. The menace of police brutality is
critical because it has had far-reaching effects on the way people perceive the law enforcement
agencies and officers of the country and therefore by extension, affected the way the police and
the criminal justice system works. One of the most prominent recent cases of police brutality was
the case of the killing of Mr. Michael Brown in Ferguson in 2014. The case led to violent and
peaceful protests across the country as well as Internet campaigns that have led to changes in
policies and society.
In summary, Michael Brown, an 18-year-old African American student was shot to death
by a white policeman called Darren Wilson. The shooting happened in Ferguson city in
Missouri. Brown was in the company of Dorian Johnson, a 22-year-old friend (Brown, 2015).
According to Darren Wilson, an altercation happened between him and the victim when Brown
attacked him and tried to take his gun while they were in a police car. Brown and Johnson then
ran from the car, and Wilson followed them. In the process, he shot Brown when Brown charged
at him. Wilson fired his gun 12 times and shot Brown six times. The event led to protests across
Ferguson. However, the federal bureau of investigation later found that Wilson was not guilty of
the killing because the evidence to show that the victim raised his hands or even asked the police
officer not to shoot was not there (Carney, 2016).
Nevertheless, other sources said that Brown said: “don’t shoot.” Protesters shouted
“Hands up, don't shoot" in their peaceful and violent protests for more than a week. In November

of 2014, the grand jury that had been called to hear the case decided not to indict Wilson as there
was no sufficient evidence to show that he violated any civil rights. Therefore, the Department of
Defense decided that the shooting of the teenager by the police officer had been for self-defense.
The investigations involved three autopsies that found that the victim was shot six times and
twice on the head. The incidents led to social unrest and the “Hands up, don't shoot" campaign,
the black lives matter movement and the formation of a task force by the then president of the
U.S. Barrack Obama (Brown, 2015).
The social construction process was used to construct the shooting of Mr. Brown as a
symbolic racial crime. The shooting represented the racial discrimination in the police case. The
event happened after a history of police brutality against African Americans and in the context of
racial discrimination that African Americans face in the society. The shooting had come shortly
after another African American man had been chocked to death by a white officer (Hafner,
2018). Therefore, people linked the events to the recent crimes against African Americans and
decided that the event was a representation of how the police viewed African Americans in the
country. The “Hands up, don't shoot" Campaign that resulted from the shooting shows how the
society felt about the shooting (Carney, 2016). The campaign slogan originated from the
allegations that during the incident, Brown put his hands up and asked the policeman not to
shoot. The slogan was used in demos in Ferguson and other parts of the country where the
demonstrations spread to. The slogan represented a call against police brutality. The campaign
was crucial because it is what led to the ignition of the black lives matter movement that went on
in the United States and other parts of the world. The black lives matter movement represents a
call for the police to respect the lives of African Americans. The construction of the crime as a
symbolic one against African Americans is also rooted in the fact that apart from the recent

violence of the police against African Americans, there is also a long history of the police being
used by the authorities to oppress the African Americans.
