AND MANAGEMENT RESEARCH PAPER CRITICAL ASSIGNMENT Prof. April Frisby Topics-Choose ONE* Topic 1: The American with Disabilities Act (ADA) was enacted in 1990 to prohibit discrimination and guarantee that people with disabilities have the same opportunities as everyone else to participate in American life— employment opportunities, to purchase goods and services, and to participate in State and local government programs and services. (www.ada.gov) The ADA has been criticized that it lowers employment opportunities for the disabled and increases the costs of doing business which is particularly detrimental to small businesses. Please address each of these criticisms (including addressing arguments for and against each criticism) and if either (or both) are realistic criticisms, the benefit of the ADA overall in light of such criticisms.   Topic 2: Religious discrimination involves treating a person (an applicant or employee) unfavorably because of his or her religious beliefs. The law forbids discrimination when it comes to any aspect of employment, including hiring, firing, pay, job assignments, promotions, layoff, training, fringe benefits, and any other term or condition of employment. It is illegal to harass a person because of his or her religion. However, the rules for what constitutes harassment are not that clear-cut. Harassment can include, for example, offensive remarks about a person's religious beliefs or practices. Introduction
In the US, discrimination against persons with disabilities is a criminal offense

punishable by the law. The constitution provides the guidelines that business entities and leaders
should follow and observe when it comes to the employment of members of the community who
may have various disabilities. Recently, the enactment and implementation of the American with
Disabilities Act otherwise abbreviated as ADA created a platform that made it easy for the
general public to perceive the concepts of equal employment opportunities to all regardless of the
underlying physical and or mental challenges exhibited by certain people. The enactment of the
law came as a result of the increased cases of discrimination of the general population that
presented various types of disabilities (Francis & Silvers, 2015). In the past, many companies
refrained from employing people based on their physical and mental health outlook.
This behavior saw many disabled people fail to acquire jobs regardless of their level of
qualification. On the other hand, many companies disregarded the requirements of the disabled
people which increased the level of suffering which in the end made it hard to offer equal
employment opportunities without discrimination or bias to all. The primary basis for this paper
comes from the desire to address the potential critics that ADA received from various
perspectives based on the current state of work in the respective organizations (Goldsmith,
