A constructive discharge takes place when an employee such as Deborah in our case is
forced to quit because of the unbearable working conditions made by the employer. The
intolerable conditions that Deborah was subjected to include mistreatment, discrimination and
negative change in work promotion pay. Deborah was thus forced to resign because of the
constructive discharge imposed by her employer (Cihon & Castagnera, 2017). She, therefore, has
a claim on the employer. However, Deborah has the burden of proof. She needs to prove that she
was mistreated at work by her employer. She must show that she tried contacting the human
resources, supervisor but the harassment just continued. She will be required to prove that the
working environment was intolerable and brutal that any employee would have quit. She would
