There are famous examples of appropriation  of industrial designs, such as for example Andy Warhol's 1968 Campbell soup cans , who was involved in a few lawsuits. According to Wikipedia, Gilson's opinion is that the 1968 Campbell soup can art pieces are not in direct competition with soup business. In my opinion, given the success of the art pieces, Campbell soup may be promoted through the distribution and exhibition of the Warhol art. The art pieces obviously acknowledge Campbell soups. Nevertheless, Campbell soups may not have received money for the use of the design of the actual label Campbell soups. There are other famous artists that have used appropriation in the art pieces.
