This dispute centers on the landfill that is operated by Baltimore County and Sue Smith
as a private citizen whose land is near the landfill. When Sue Smith bought her land, the landfill
was not yet there. Instead, the land that was converted into a landfill was wooded. Due to the
landfill being near Sue Smith land, she is justified to sue the county for accepting hazardous
waste and other trash that were harmful to the environment. The best court that she can file a
lawsuit against Baltimore County is District Court which is going by the fact that district court
judges have the ability to try cases either civil or criminal.
