Introduction
This is the case involving a tenant and her landlord, the former being Elizabeth O’Cain
who is the complainant, while the latter being the defendant. The complainant seeks damages for
emotional and mental distress arising from the rape of her roommate G.S and burglary in her
apartment on the night of Oct 15, 1981. However, the trial court considered the landlord’s filing
of the motion summary application, rejecting Elizabeth’s initial application as the former’s
