Before the juvenile courts were established, children charged with delinquent acts were
tried in the criminal justice system. However, the age of the children played a role in establishing
whether the child was guilty where children below the age of fourteen years were presumed not
to have adequate criminal capability to commit a crime. The establishment of juvenile courts
changed the assumption by offering exclusive jurisdiction towards individuals who are eighteen
years and were charged with a violation of criminal laws in most states. This paper will focus on
discussing juvenile justice system where it will begin by discussing its historical development,
origin and predominant philosophy. It will also discuss the differences between juvenile and
adult system, dependency and delinquency as well as the reasoning and the significance of
confidentiality in the juvenile justice system.
The juvenile justice systems were customized in the United States more than a century
ago because the first juvenile case was held in Illinois in 1899. Between 1960 and 1980 juvenile
courts were unable to achieve the goal of providing rehabilitation and therefore in 1960 activists
fought for the development of juvenile courts. In cases like Kent v. U.S. 383U.S. 541 (1966), In
re Gault 387 U.S.1 (1967), and In re Winship 397 U.S. 352 (1970) the Supreme Court
established new social regulations that protected children rights to challenge arbitrary
