Discuss the decision of Missouri v. Seibert (2004). Do you agree or disagree with the Supreme Court’s ruling? Can you think of an instance where this technique could have been beneficial despite the Constitutional ramifications?

this was a discussion of the suprime court of the united states that really struck down the police practice of first obtaining an inadmissible confession without giving the miranda warning.justice David Souter was the one who announced the judgement the court had made.this case actually tested the police protocal for custodial interrogation.Respondent Seibert feared charges of neglect when her son, afflicted with cerebral palsy, died in his sleep.Failure to give Miranda warnings and obtain a waiver of rights before custodial questioning generally requires exclusion of any statements obtained. Conversely, giving the warnings and getting a waiver generally produces a virtual ticket of admissibility, with most litigation over voluntariness ending with valid waiver finding. This common consequence would not be at all common unless Mirandawarnings were customarily given under circumstances that reasonably suggest a real choice between talking and not talking. Pp. 4–6.the police in this context did not follow the constituon but i think it was neccessary since concrete evidence was needed for this case  on what led to the death of her son.i totally agree with the Supreme Court’s ruling since the police failed to follow the set protocals.

the above instance can be beneficial in a situation whereby the security agencies have a prime suspect, maybe a terror suspect.in such a situation security matters come first and answers are needed by use of whatever means.
