Legal issues in health care
Legal issues are common in health care and particularly in nursing practice. As
reported by Bari, Khan and Rathore (2016), these issues have many implications on the
responsible parties and the facility including fines, suspension or loss of licenses for notorious
healthcare professionals, negative publicity, and even a decline in market share. However,
many of these legal issues can be easily mitigated through joint efforts by both the healthcare
facility and the healthcare professional. This paper analyzes a recent legal issue in nursing
practice, risk-mitigation techniques that the healthcare facility could have implemented to
prevent the problem, and the measures that the nurse could have taken to improve the
outcome.
The selected legal case study involves an intensive care nurse. As explained by the
Nurses Service Organization (n.d), the legal issue involved medical malpractices including
medical administration error, failure to monitor the patient, failure to alert the physician about
the condition of the patient, and a failure to document actions of the nurse. It was found that
the nurse administered the wrong dosage of medication, failed to follow the physician’s
guidelines about the timing of medication, and administered medication through the wrong
