In proving an assault, the following are the three elements which are required:


“An act intended to create”: In this case, an assault is judged as to whether the defendant
acts with an intention of creating a state of fear or danger to the victim (Gill et al., 2019).
The victim must therefore be terrified or have fear based on the expression of the
defendant.



“A reasonable apprehension”: As an element of proving an assault, the victim must have
the conviction and belief that the defendant could have harmed them. The victims
therefore have to respond to the acts of the individuals and their perception is considered
a great proof.



“That is either harmful or offensive”: In proving an assault, the defendant’s action must
show that he/she was daring, physically threatening or evoking signs of fear on the
victim.
