Project 1 is a very straight-forward exercise that requires you to complete two major tasks.

1) Draft an application/affidavit for a search warrant, search warrant and return for any applicable place, person or motor vehicle. For purposes of the exercise assume the application/affidavit will be presented to me, Judge Solomon Wise, Judge of the District Court of Maryland for Chesapeake County.

If Officer Brutus only had information outlined in paragraphs number 1 through number
4, he would still have probable cause for a search warrant. Officer Brutus would have a probable
cause based on “totality of the circumstances” which allows individuals to make decisions based
available information rather than adhering to laid down guidelines (Kinports, 2014). The “totality
of circumstances” was applied in the Navarrete vs. California Case, where an anonymous call
was made to the police claiming that a man was driving while drunk. The informant made a 911
call claiming that the driver of a silver Ford pickup truck had forced the informant off two-lane
road a few minutes earlier. The information provided by the informant enabled the police to
substantiate dangerous driving before stopping the vehicle that Mr. Navarrete was driving
(Navarette v. California, 2014). On stopping the silver Ford Pick-up truck, the driver matched
the descriptions and was drunk beyond the legal limit. The court ruled that the police had
reasonable suspicion of drunk to pull over Mr. Navarrete.
