Assignment 1: The State Judicial Selection Process
Due Week 5 and worth 200 points
Each state within the United States has its own unique judicial selection process within its own court system.
Using the Internet or Strayer databases, research the judicial selection process for different court systems from different states within the U.S. Court System.
Write a five to eight (5-8) page paper in which you:
- Discuss the judicial selection process of your state. Include, at a minimum, the qualifications and steps that are taken in order to select judges for the different kinds of courts within your specific state.
- Choose a second state, and describe the qualifications and the selection process for judges within that state.
- Compare and contrast for both states the qualifications necessary for a prospective candidate to become a judge. Next, identify the steps that the relevant persons / entities need to take in order to remove a judge from office for disciplinary reasons for each state.
- Justify the selection process for the state that you believe has the best system in place. Justify the response.
- Use at least three (3) quality academic resources. Note: Wikipedia and other websites do not qualify as academic resources.

In the US, different methods that the individual states use for judicial selection exist.
Each state has a unique set of guidelines that help to govern the selection process, and fall in five
primary methods. The first method of judicial selection is the partisan election where people
elect the judges using ballot having the labels that designate the political party of the candidates.
The nonpartisan election is similar to partisan election method, but the difference is in a
nonpartisan election, there is no label on the ballot that designates the party affiliation of the
candidate. The third method of selecting judges in the US is that of legislation election where
state legislatures take the responsibility of selecting the judges. The gubernatorial appointment
comprise another method for selecting the judges in America where governors have the
responsibility of appointing judges, and in some cases, the legislative body should approve the
selection process. The last method of judicial selection is that of merit selection where the
nominating commission plays a significant role in reviewing the qualification of judicial
aspirants and give the lists to the governor who will take the responsibility of appointing the
judges from the list. This paper focuses on the process of selecting judges in the Supreme Court
and Court of Appeal and compares the methods between the states of New York and Virginia.
Election and appointments are the two main methods that the United States uses in
selecting the judges. Some states prefer electing judges, but most consider the combination of the
elective and appointive processes. Nowadays, more than thirty-three states in the United States
employ the merit selection method while choosing their judges. In the election method, the
candidates run in partisan campaigns then the people decide who will become the judge through
