(Please find an example no other student has posted about).Per textbook, intellectual property includes patents, trademarks, copyrights, trade names, trade dress and trade secrets and the protection for this property rights comes from federal law and common law as well as international treaties. The example I am choosing for this week’s discussion is the dispute between Girl Scouts of the United States of America (GSUSA) and Boy Scouts. In November 2018, Girl Scouts filed the lawsuit against Boy Scouts for trademark infringement after they announced its intention to drop the word “Boy” and change the name to Scouts BSA in an effort to attract girls to the organization. United States Patent and Trademark office identifies trademark infringement as “the unauthorized use of a trademark or service mark on or in connection with goods and/or services in a manner that is likely to cause confusion, deception, or mistake about the source of the goods and/or services”. In this dispute GSUSA is claiming that only they have the right to use Girl Scouts and Scouts trademarks with services for girls and arguing that Scouts BSA will damage the goodwill of GSUSA and cause the confusion among the public. Trademark law is a federal issue, and trademarks are governed by the federal statue Langham Act. According to the Cornell Law school, “likelihood of confusion” when using the same or similar mark for selling or advertising the goods is one of the three distinct pieces that are necessary to establish a trademark infringement case, which GSUSA is claiming in this case. The dispute between GSUSA and Scouts BSA is still outgoing.   What remedies are available to IP owners and what are the elements needed to prove and win a case in court. For the IP infringement the available remedies are monetary damages, temporarily or permanent injunctions and attorneys’ fees. These remedies are cumulative. In copyright infringement cases the copyright owner can be awarded with the loss’s recovery of actual damages, statutory damages or even infringer’s profits. To prove and win a case for the IP, the owner must first show the legal existence of the IP and its ownership. According to the Cornell Law School Legal Information Institute, in the Trademark infringement case the main element for the legal dispute is mark’s use in commerce that could cause the likelihood of confusion. In the copyright infringement case, the copyright holder must prove that the copying party had access to the original work, the two works are substantially similar, and the copyrighted material is used for commercial or educational use. In the patent infringement case, the patent owner must show the elements of the product performing substantially the same function in substantially the same way to achieve substantially the same outcome.What is the law in regards to employee's IP rights and limitations when they are working "within the scope of their employment?"  This is a general question unless you are working.  If working, see if you can provide your employer's policy and share with the class.  Provide a source for your answer.  As a general rule, in the absence of the agreement to the contrary between the employer and employee, an employer is entitled to the nonexclusive license to use the invention created by the employee while he/she was employed in the company. However, the invention is actually owned by that employee who has the right to exploit it commercially, unless that employee was employed precisely to work on that invention and signed the invention assignment. Shopping doctrine under Us Patent law grants employer the IP rights to the invention only for the time frame that the employee is working for that employer. The only exception to this principle is the Work for hire concept in Section 101 of the Copyright Act (title 17 of the U.S. Code) that says if the specific work is made for the specific hire then an employer is considered an actual author of the work and has full IP rights to the invention.
