University of the Rockies Sexual Harassment and Dispute Resolution Processes HW
You have been hired by a medium size company to investigate a sexual harassment complaint and to recommend a plan of action for resolving the conflict. The company hired Sarah Williams, a 25-year old college graduate, to provide administrative support for three executives. Ms. Williams took this job with the company in hopes of being able to work towards higher level positions in the company. She has worked for the executives for three years. The executives are all well-respected in the industry and in the company and bring in a tremendous amount of money for the company. One of the executives, Jack Griffin, has extremely high expectations for the employees that report directly to him. He creates a stressful, fast-paced environment for everyone. He expects Ms. Williams to not only perform her administrative duties but also bring him coffee, order and pick up his lunch, and perform other personal tasks. Mr. Griffin is also known to use profanity and to yell at employees during the course of the workday, including Ms. Williams. The Human Resources Director has talked with the President of the company about Mr. Griffin’s behavior, but the President has chosen not to get involved because Mr. Griffin brings in a tremendous amount of business and clients love him. He believes Mr. Griffin is just enthusiastic about his work and the assistant is disgruntled because of her place in the company. Mr. Griffin occasionally buys Ms. Williams lunch when she gets his lunch, gives her gifts, and compliments her on her appearance. He also invited her to a professional football game with clients and other employees from the company. Ms. Williams often works overtime for the company to complete her work. She has never felt appreciated for her work, nor does she feel she is adequately compensated for her efforts. She has applied for other jobs in the company, but has not received the promotion she thinks she deserves. Ms. Williams is tired of not being promoted, tired of the stressful environment, and tired of Mr. Griffin’s use of profanity. She believes Mr. Griffin is responsible for her lack of success with the promotional opportunities within the company. Mr. Griffin finds Ms. William’s job performance to be satisfactory and is either unaware or unconcerned about the stressful environment he creates. Ms. Williams complained to the human resources department about Mr. Griffin’s behavior and was advised to address the issues directly with Mr. Griffin. Ms. Williams filed a sexual harassment claim against Mr. Griffin. Mr. Griffin believes the claim is unfounded and refuses to take the time to deal with the matter. He believes his work for the company is more important than dealing with the claim. The other two executives are now finding Ms. Williams’ work performance to be deficient because she has begun to call in sick regularly. Prior to this, her work for them had been above satisfactory. While they were aware of Mr. Griffin's behavior, Ms. Williams had never complained and they just chose to work around his behavior. After all, they received great bonuses each year because of the clients and money Mr. Griffin secured for the company. The HR Director has asked you to investigate the claim and resolve the conflict. Specifically, they know Mr. Griffin’s behavior creates a stressful environment but no one has been willing to address it because of his success. Use at least five peer reviewed resources in addition to the text. The paper should be between 2,800 – 3,500 words, excluding title page, reference page, and any appendices. The following should be addressed in the paper:Diagnose the networks of influence within this organizational conflict situation to determine how to influence the leaders in the handling of this matter. Identify obstacles to resolution. What techniques and strategies will you use to influence the leadership of the company to properly deal with the matter?Evaluate available resolution strategies and determine which method would be most effective. You should be able to explain why resolution through mediation is more beneficial than litigation.Analyze the characteristics of the leadership in the company to determine how best to gain their “buy in” in resolving the problem.Ultimately, you will advise the company that the matter should be mediated. Be prepared to advise the company on how to choose the mediator, who should be involved in the mediation, and the type of mediation that would best suit this situation.Your paper should follow APA 6th edition guidelines for in-text citations and references.
