Question description

Kirby sues Carvello in Federal court. Kirby files her complaint and properly completes the service of process.  The summons requires Carvello to respond in 21 days with his answer to the complaint. Carvello responds in 25 days. What happens next?

The court enters a default judgment against Carvello for failing to respond to the allegations and awarding Kirby the damages alleged in her complaint

The court enters a Motion to Compel against Carvello on day 22 to compel him to submit an answer to the pleadings

The plaintiff, Kirby, must file an amended complaint against Carvello. 

The court will set a pre-trial hearing to commence proceedings on the pleadings.
