Topic: The abuse of copyright strikes by big companies on Youtube Thesis: The copyright system is flawed and abused on platforms such as YouTube by big companies, highlighting that copyright laws need to be modernized to protected creators and our freedom of expression. Target Audience: Inexperienced/beginner Youtubers, as well as social media influencers. Outline: 1.Define copyright -both in general terms The dictionary definition of copyright is: the exclusive legal right, given to an originator or an assignee to print, publish, perform, film, or record literary, artistic, or musical material, and to authorize others to do the same. What this means is basically the protection of innovating something that a creator feels is rightfully theirs. as well as allowing them value rather than everyone owning this project. -and its application for youtube Content creators on youtube are not allowed privilege. Youtube has a strict policy of having copyright strikes on your channel. Each strike can have the consequence of warning, video removal, and channel termination. This has sparked a ton of controversy with some creators not doing much and getting strikes on there personal channels. Could you really blame Youtube for being cautious with this certain strict policy. 2.Define fair use -both in general Fair use technical term is the following: the doctrine that brief excerpts of copyright material may, under certain circumstances, be quoted verbatim for purposes such as criticism, news reporting, teaching, and research, without the need for permission from or payment to the copyright holder. Certain pieces of art allow fair use or “royalty free” which gives the user privilege to use this product. For example, there are artists on platforms that allow music to be used on videos. -and its application for youtube Going back to the “royalty free” products stated above this is how certain channels get access to background music. A loophole certain people find useful is remixes or instrumentals of popular licensed songs also does the trick. Luckily, Youtube’s algorithm does not allow this to be striked and creators can freely enjoy making content with no penalty. 3. Describe how the copyright/fair use abuse has impact on freedom of speech, freedom of expression, and media. The first amendment of the U.S, constitution gave life to the constitution by the protection of individual freedom. The amendment has had a huge impact on improving the lives of people while protecting their values. The first impact is that the citizens can now speak freely without the fear of being intimidated and repressed by the government (Fiss, 2018). The fundamental right of speech is protected by the constitution, and no authority can prevent citizens against speaking. Individuals are now free to express themselves in any way. There is not preferred way of expression that has been established, and citizens can use this protection to express themselves freely. The freedom to the press has seen the development of the media which has facilitated news coverage and protection against censorship (Fiss, 2018). The media now plays the role of informing the citizens and highlighting issues in the society which draws the attention of the government to act. Freedom of religion has seen the development and spread of various religions in the country. The government cannot bar religious groups from assembling and worshiping since it is a constitutional right for every citizen (Fiss, 2018). The freedom to demonstrate and petition the government has allowed the citizens to put the government on the task in the provision of social services. The citizens can now demonstrate to express their dissatisfaction and call for action for certain things to be addressed by the government. 4.What can creators do against the copyright abuse. Creators develop content which can be copyrighted to prevent other creators from using their content. Copyright abuse is a common phenomenon that has led to a myriad of cases between creators and new content creators. One of how creators can do against copyright abuse is by using caution whenever they are not using their original work (Phillips & Street, 2015). The use of caution is an ethical way of admitting that some of the content created has been borrowed from other creators and that the creator is aware of this kind of content. Creators can further exploit ways in which they can fairly use copyrighted materials (Phillips & Street, 2015). Fair use allows creators to critique, comment or parody existing content. Creators can further enter into agreements if they are working with other authors (Phillips & Street, 2015). The agreement will stipulate what is acceptable and how the content developed can be used by each of the creators. Creators should also read widely to establish what amounts to copyright abuse so that they avoid developing content which could easily be flagged off for copyright infringement. When creators work with relevant authors, they can easily avoid scenarios where they are sued or shamed for abuse of copyright.
