In this Assignment you will become more familiar with the fiduciary duties of the real estate professional as regards clients and potential clients. You will also have the opportunity to practice creating an audio visual presentation which can be important both in the job market and as a marketing tool and a client service skill. Once you learn how to create an audio visual presentation, you can send a link to a client or to a potential employer which allows them to hear your explanation of your visual presentation.
Fiduciary duties (as part of the real estate professional duties) are an essential component in governing your actions both with your client, the clients of others, and to unrepresented third parties. In a 10-12 slide PowerPoint presentation with audio, which includes the title and references slides, describe what these duties are and what duties you owe to clients and to others involved in a real estate transaction. Use three to four bulleted points per slide and place your notes below the slide in the notes section. Include at least three references from sources outside your reading in your slide presentation.

In the town of Smallville there are two real estate brokers. Broker Jones’ office is on the east side of town and broker Smith’s office is on the west side of town. Together these two brokers control all the real estate transactions in town excluding those done between private parties.
Lately, in an attempt to increase income and market share they have been having a listing war where each has been lowering their commissions to break into the others market. However, on this fine, sunny day, they find themselves on the town’s only golf course playing a round of golf. They discuss their current competition and decide that in order to increase income, instead of having a listing war; they can both increase their income by only accepting listings at 7% and only accepting listings in their current market area. They also agree to refer any listings outside their market area to the other broker. Homeowners who want to sell their houses have become upset with this arrangement and have sued the two brokers.

In the above case study involving the two brokers, namely, Jones and Smith, there was a
clear incidence of price fixing and market division, which shows a violation of the Sherman Act.
The Sherman Act prohibits any activity that results in collusion among service or product
provides to facilitate fair competition and also maximum benefiting of consumers. Therefore,
the occurrence of a collusion between the two brokers would lead to unfair competition in Small
Ville, which results in increased costs when selling houses. In the case study, the two brokers did
not only fix their listings at 7% to make house sellers indifferent but also divided the market by
