Fiduciary duties (as part of the real estate professional duties) are an essential component in governing your actions both with your client, the clients of others, and to unrepresented third parties. In the town of Smallville there are two real estate brokers. Broker Jones’ office is on the east side of town and broker Smith’s office is on the west side of town. Together these two brokers control all the real estate transactions in town excluding those done between private parties.

They also agree to refer any listings outside their market area to the other broker. Homeowners who want to sell their houses have become upset with this arrangement and have sued the two brokers.

clear incidence of price fixing and market division, which shows a violation of the Sherman Act.
The Sherman Act prohibits any activity that results in collusion among service or product
provides to facilitate fair competition and also maximum benefiting of consumers. Therefore,
the occurrence of a collusion between the two brokers would lead to unfair competition in Small
Ville, which results in increased costs when selling houses. In the case study, the two brokers did
not only fix their listings at 7% to make house sellers indifferent but also divided the market by
