Introduction: The Need to Protect Individual Rights in Criminal Procedures
The main purpose of the justice system is to be fair both to the victim of the crime
in question and the accused: it should offer the accused an opportunity to prove their innocence.
Indeed, the accused, just like every other citizen, is guaranteed, by the constitution, certain rights
that are intended to protect the individual from investigation and prosecution procedures that are
discriminative and do not offer the accused an opportunity to prove their innocence. Such
provisions are contained in the fourth, fifth, and sixth amendments, with statewide oversight,
carried out via the fourteenth amendment.
The Fourth Amendment
Amendment IV commonly referred to as the Fourth Amendment to the US
constitution. The amended section of the Bill of Rights provides that ‘individuals’ right safety
and security in their residences, persons, personal documents, houses, and effects, against any
form of inappropriate seizures and searches, shall not be violated. Warrants to search the listed
shall be issued, upon proving probable cause, which shall be supported by affirmation or oath,
especially detailing the region to be searched, and the items or persons to be seized’ ("Fourth
