She had gone to a lot of expense with the food and drinks and even bought a new outfit for herself. She is threatening to sue Darius and Tom for the cost of the food and drinks and her new outfit. (2 marks) b.Ben entered into a contract with a firm of computer suppliers for a new computer. Ben is a tax accountant who is self-employed and works from home, so he needs a computer for his work. His current and only computer was not working too well so Ben placed an order for a new computer and the suppliers informed Ben he would have his new computer within the next 4 days. During this time Ben’s old computer died so he could not do any of his work. The 4 days ended up being 4 weeks before the firm supplied Ben with his new computer. So Ben spent the time watching his favourite soap operas on TV. As a result Ben lost some clients and incurred a financial loss. Ben being an accountant has calculated his lost revenue as being 10,000 dollars. He is expecting the firm to reimburse him for the whole amount. In a lawsuit, the burden of proof refers to the obligation to present evidence on the
subject of the criminal charge or lawsuit. In a criminal trial, the offense is always against the
state or federal government, and the burden is in the prosecution while in a civil suit, the crime is
against another person, and the responsibility lies on the plaintiff, and it may shift on the
defendant (Herring, 2018). The standard for criminal activity is usually higher because the state
has to prove beyond any reasonable doubt of the activities while in a civil action the standards
are lower because the plaintiff and the defendant are available to respond to the lawsuit and
prove the facts (Kwon, 2012). In other words, criminal actions have severe punishments which
make it more demanding to proof accurately while civil action has less punishments

supplier. An example of a criminal action include such as forgery, and in many cases, crimes in
business are always white collar crimes. The same action can result in both criminal and civil
litigation. An example of such an action is a fraud. Fraud is a crime that is always confused as a
criminal and civil action. The primary difference between civil fraud and criminal fraud revolves
around who is pursuing legal action in the case. When prosecutors pursue the fraud it becomes a
