Ratified in 1791, the first 10 Amendments establish American civil liberties: the freedoms of U.S. citizens which are protected from infringement by the federal government.Madison crafted the First Amendment to safeguard the following four liberties for U.S. citizens: 1) freedom of the press, 2) freedom of speech, 3) freedom to assemble, and 4) freedom of religion. Since the ratification of the Bill of Rights, scholars and legislators have debated the Founders’ intentions with certain Amendments, such as the First Amendment. The extent to which the nation has grappled with the intersection between law and morality on the one hand, and the role of the state in a democratic society on the other, epitomizes the challenges that result from developing a government of the people, by the people, for the people.Supreme Court Justice Potter Stewart wrote in Jacobellis v. Ohio (1964):I shall not today attempt further to define the kinds of material I understand to be embraced within that shorthand description ["hard-core pornography"], and perhaps I could never succeed in intelligibly doing so.
