For decades, the American healthcare sector was defined as an avenue of perennial
danger and public indignity that denied emergency care to poor, uninsured persons who were
primarily transferred from one healthcare facility to another before being rendered medically
stable due to the fact that it was perceived they could not afford the services. In an effort to
modify the outrage that was the American healthcare culture prior to 1986, significant efforts and
resources were directed towards transforming the health sector, halting these atrocities against
humanity as well as achieving global health. The enactment of the Emergency Medical
Treatment and Active Labor Act was among the first enforcement efforts directed towards
tackling the problem of patient dumping that denied uninsured, poor patients emergency
treatment. This regulation posed an unfunded mandate that requires healthcare institutions to
provide screening and immediate medical examination to any individual requiring emergency
