Write an essay indicating whether you believe the Judicial Branch is impartial. Judges are appointed by elected officials in most states and all Federal Judge are appointed by the President and confirmed by the U. S. Senate. Federal Judge are never subjected to voter approval and can not be removed unless impeached which is nearly impossible. State Judges in California can be removed by a Committee on Judicial Performance and also must run for election every 6 years. Which is better? Introduction
The judicial branch cannot be entirely impartial or independent because judges will often
encounter external or internal pressure from the political bodies in the parliament. This,
therefore, compels them to be involved in political affairs when acting as policymakers which
influence politics. Although appointing judges minimizes their degree of prejudice compared to
those who have to be elected since they must please the constituency hence forced to interfere
politically. This makes the United States judicial system better compared to that in California.
