Part I

Compare and contrast professional misconduct and conduct unbecoming a regulated
immigration consultant. 4 Marks
The Immigration Consultants of Canada Regulatory Council (ICCRC) protects and
promotes public interests public by overseeing authorized immigration professionals. In this
case, the ICCRC ensures they adhere to the professional code of conduct (ICCRU, 2019). To
obtain a license for a regulated immigration consultant, a candidate must be ICCRC-registered.
The core role of these consultants is to conduct consultations with prospective clients globally to
advise them on the various eligible immigration scenarios to Canada or between Canada and the
United States. When a regulated immigration consultant is said to have professional misconduct
or conduct unbecoming, he/she have violated the code of ethics of professionalism. Regulated
immigration consultants must uphold professional obligations by providing a professional
standard of service (Kwan, 2019). Both professional misconduct and conduct unbecoming means
that the consultant is guilty of inappropriate service to the clients, conflicts of interest, and did
not respect the confidentiality of the client. Conduct unbecoming differs from professional
misconduct of regulated immigration consultants. In this case, conduct unbecoming refers to
behavior that is contrary to the interests of the public. In contrast, professional misconduct is
unsatisfactory conduct that involves consistent failure to maintain reasonable diligence or
standard (Duhaime, 2019).
