As state agents, prosecutors take an oath that implores them to protect both the
Constitution and seek justice for state and vulnerable citizens in criminal as well as civil cases.
As such, based on the tasks and duties performed, the prosecutor has a robust influence over
cases. However, due to the execution of certain duties, they face ethical dilemmas. The American
Bar Association (2018) asserts that a prosecutor plays an administrative role and as a zealous
advocate for the rights of the victims. The prosecutor as a court officer is expected to exercise
proper discretion as well as autonomous judgment in the execution of their prosecutorial
functions. The main task of the prosecutor is seeking justice within the law and not just
convicting defendants.
As such, the prosecutor investigates crime in collaboration with police officers. The
prosecutor also instigates legal proceedings against a suspect and appears in court to ensure that
justice prevails for both the accused and the plaintiffs. The prosecutor evaluates existing
evidence to institute legal proceedings against a suspect (ABA, 2018). The prosecutor helps
suspects enter plea bargaining; especially in cases where a minor admits to their criminal
offenses thus leading to summary punishment. The prosecutor has a duty to protect the innocent
and attain a conviction for those guilty of charges.
