Introductory Question
The tribal courts in America are offering vital roles in the American Society. They have
jurisdiction over the Indians and non-Indians who resides on the federal Indian reservation. Even
though the American Indians are recognized as America citizens, minor crimes and civil cases on
the reservation areas are dealt with in the tribal courts and not state courts for the reason of
specialization. The second reason is for better delivery of justice and application of laws governing
the reservations.

The captured enemies should not be tortured or killed because it will be against the third
Geneva conventions. This is a jus cogen in the international humanitarian law that need not be
negated. According to US laws, it is also not allowed to kill or cause great bodily harm to any
person without any legal justification. However, the protection of captured enemies has been
criticized by other scholars who argue that a soldier defending his country need not be subjected
to humiliation due to the fact that he killed or maimed captured enemies.
