The new final Charge Rule policy seeks to amend the US Department of Homeland
Security by explicating the way the department qualifies the inadmissibility status of an alien’s
application for admission to the U.S as stipulated by the Immigration and Nationality Act under
section 212 (a) 4 of the act. Notably, the alien may be considered a public charge at any time.
The final rule defines various terms that are critical to the determination of public charge
including terms like Public Benefit” and “Public Charge,” because of their definition lack in the
statute. A public charge is any person who may become a burden to the government of the
United States by depending fully on the government for subsistence as depicted by the
institutionalization for extended care at the expense of the government or by receiving public
cash aid as income maintenance.
Therefore, the rule explicates various factors that the department considers in overall
conditions when determining public charge inadmissibility. Also, the policy discusses the
authority of the USCIS for the issuance of public charge bonds concerning the application status.
Further, the policy demands that the aliens requiring extensions in the stay in the United Status
or need their status altered to show that they have never changed or received public benefits for
the threshold since they obtained their nonimmigrant status. While the Department of Homeland
