Nevada Revised Statute 651.065 says “....is not unlawful and is not a ground for a civil action for any place of public accommodation to offer differential pricing, discounted pricing or special offers based on sex to promote or market the place of public accommodation.”

Under Nevada law a “place of public accommodation” includes a nightclub, which are very popular in Las Vegas.

So, basically, Nevada says it is legal to intentionally discriminate against men when it comes to charging entry fees to nightclubs. In other words, it is legally permissible for a nightclub to charge men a $40 entry fee but to allow women to enter for free. That decision is based solely on gender.

This was one of the highly regarded cases in the American Supreme Court that gave the
Congress the power to compel the private firms to abide by the Title II of the Civil Rights Act of
1964 that bars discrimination in the public facilities. It is one of the cases that have managed to
abolish the segregation system that continued to separately treat the white and the African
Americans in terms of treatment, accommodation and provision of services.
Facts of the Case
The Plaintiff (the Motel) Position
In the heart of Atlanta, there exists a 216-room motel that could be used by any member
of the congress. Nevertheless, the organization denied the African-American patrons the right of
accommodation. The owner of the premise Moreton Rolenston filed suit in federal court
claiming that the Civil Rights Act of 1964 exceeded the power that was granted to the congress
over the interstate commerce. On the other hand, Moreton maintained that the requirement
violates his Fifth Amendment rights on choosing his right customers and how to operate the
business. Finally, the plaintiff felt that the Congress had subject him to a position of involuntary
servitude when he was compiled to provide the room to some of the clients whom he may not
need. In his opinion, he felt that he was not comfortable by the African-Americans.
