Abstract
There are many laws in America to stop and control offenses, even though the crime rates
are increasing since the sentences are not adequate for the crimes. Such punishments in America
include capital punishment. Capital punishment is a government authorized practice whereby a
person is put to death by the government as a penalty for criminality. Several countries,
including America, still retain capital punishment. Although there are many books and papers
written on this subject, it seems, however, both ethically and intellectually right and beneficial to
redact a study of this juridical phenomenon. This paper aims to look at why capital punishment is
still prevalent in the modern United States of America to understand the issue.

CAPITAL PUNISHMENT
Introduction
The United States executed 25 convicted murderers in 2018. The number is likely to be
higher in 2019, with 17 already executed and a number still on death row. Surprisingly, the
number of people to be executed in 2019 will not be much higher in 2019 compared to 2018
because Ohio suspended all executions until a much better protocol on how to carry out the
executions is found. A few inmates have also been pardoned, with October leading with a
surprising nine out of ten executions being stayed. While this may just be a normal occurrence, it
is hard not to wonder if the death penalty is slowly but surely on the decline in the United States.
Literature Review
The concept of capital punishment is one of the most hotly debated topics in America,
with proponents and opponents both giving very strong arguments on why or why not this
method of punishment should be used. Being the liberal country it is, America has allowed each
of its states to decide whether they want to embrace capital punishment or not. This led to capital
punishment being concentrated in some areas, with Texas leading in the rate of executions every
year. There are different aspects studied in an attempt to define capital punishment and what
affects the probability of one being sentenced to death. Kramer, Ulmer & Zajac (2017) studied
two aspects, which include the race of victims and defendants, and its effects on a conviction.
These authors noted that there is a higher chance of capital punishment if the defendant is an
African American and the victim was white. The authors also discovered that Hispanic
defendants had the highest probability of being handed the death sentence, regardless of the race
of the victim.
