La’Donna Hawkins-Rhodes Professor Weslea Bell ENG215 May 8, 2016 MINORS CHARGED AS ADULTS It is very disappointing as it is wrong to try minors as adults. It is true that the courts have at one point or the other tried minors in the same way that adults are treated. This is with respect to the way the cases are heard and also with the sentencing of the minors found guilty. The process in which juvenile cases are transferred to adult criminal court is called a waiver and there are different things that lead to this action taking place. One of the things that led to this trend is public appeal because it was observed that crimes were being committed more by the younger people who knew that they somehow had the safeguard of being underage that could see them suffer little or no consequences for the crimes committed. This led to the public to feel the need to sometimes try minors as adults to help solve this inclination before it got worse by deterring potential young offenders from engaging in vices in the society (Statsky, 2014). The judges too have played an important role in seeing to it that some juvenile cases are transferred to adult criminal courts. For the judges to do this there must be a history to go by that shows that a young offender has been on probation and it did not work. The prosecutor also can ask for this but the burden of proof lies on the prosecutor to prove why a particular case involving an offender should be transferred to adult criminal court. Some states have also come up with provisions which have to be followed by the judges with respect to some crimes that merit automatic transferring of the cases. These are heinous crimes committed by the minors. Transferring of juvenile cases to adult criminal courts has been known to come with some problems. One of the problems of this action is that it leads to the delinquent not being given a chance in the future to be tried through a juvenile process. Another problem is that it may lead to the delinquent being mistreated if they get sentenced to jail term as they will be relating with MINORS CHARGED AS ADULTS criminals older than themselves. Another example of problems brought about by transferring the cases in possibility of the minor to relapse. The problem of not giving a chance to the minors in the future to be tried in a juvenile process may seem like a small problem but it is more of a problem that meets the eye. Having the concept that the teenagers have the competence to keep away from problems is deceptive as it is wrong. Teenagers will almost always find themselves in compromising situations that would lead them on the wrong side of the law because of changes happening in their bodies that come with a facet of defiant attitudes and also due to lack of maturity to decide appropriately. Their peers will almost always lead them to making uncalled for decisions. Since the law seeks to be fair, it would be unfair negating such a helpless individual from having the same rights as their peers just because of their past behaviors. This problem is an unethical problem because it leads to double standards with the way the teenagers are treated because his mates caught in the same wrong would be treated differently. It would be noble if the law provided for a better way than having such a process set a standard for the subsequent cases. The problem of the young delinquent being abused in the jail cells is not a new thing in the world. There have been cases of the young being abused in the prison by the older inmates and guards, in some cases sodomy have been reported (McCord, et al., 2001). In such situation, the process results in creating more of a problem than what was there already. The reason for this is because to the young person who goes through such an experience, life will never be the same again. This is especially true if such a person gets infected with a sexually transmitted disease. MINORS CHARGED AS ADULTS This problem is a social problem because it leads to the relationships in the prison being distorted from the way people should relate, to people hating each other and treating each other as enemies because of the fear of being hurt while in prison. This has led to prisoners even forming gangs to protect themselves from others and for the teenager who gets caught up in such a situation, life would be very hard. According to Fagan (2000), the problem of reoffending is one that has been challenged in the past as not to hold any water but evaluating the people that have been through prisons, it is clear that reoffending is a fact. A teenager who is put in the same process as adults and imprisoned with these people will more likely reoffend in the future than the ones that did not undergo such a process. This is because people have a tendency to live by the name given to them and when teenagers are called criminals they will live up to that name. This can also result from the fact that they are surrounded by criminals whose stories might be praising criminality. This problem is a social problem and also has an aspect of economical problem. It is a social problem because reoffending will hurt the people in the society and will disrupt the relationships in the society. It could be economical if the reoffenders gets into stealing other people’s property. The above information shows how daring it is to allow teenagers to experience an adult criminal system as it has been shown to lead to harm. As it has been noted, there is a large problem when it comes to the issue of treating
minors as adults in the court of law. This has been an issue because this treatment also continues
to the prisons where these minors are jailed together with mature people that commit other
offences (Myers, 2011). But there is a viable solution to all these problems. The most effective
should be crime prevention as opposed to putting in place methods of punishing the minors that
commit crimes. My main solution to the problem is therefore: Focus more on crime prevention
as the minors are still young and willing to learn.
Solution
In any problem that is faced, there has always been more than one way of solving the
problem. For this situation, the fundamental issue is the expansion in the quantity of youthful
ones that are becoming serious criminals. This is a problem that is found in many of the places
where there are more and more minors that are being treated as if they were adults both in their
sentencing as well as in the jail system. However, the solution to helping solve the problem of
minors and crime should be focused more on the crime prevention part of the whole problem.
Considering that we are talking about minors, it is notable that all of them must have
missed some learning aspect for them to be able to end up in so many problems that requires for
them to be sentenced as an adult is sentenced. This means that it would be a good solution to
focus on teaching the young ones that crime is wrong so as to prevent them from getting into
crime in the future. This would include teaching them in the families as well as in the different
learning institutions where they may be schooling.

Advantages
Several advantages come with this solution. The first of this is that the children that are
prevented from committing crime are able to continue with their education. Education is
essential in today's general public as it ensures that a man can have high odds of landing a decent
job (Watkins, 2010). This has a reverse effect of reducing poverty and increasing the well being
of the society in general. By preventing the minors from committing crimes, we help them to be
able to continue with their education which is likely to greatly benefit them in the long term.
