Brief facts
The facts of the case were that the plaintiffs, Musick and James Character, who were
employees of Goodyear Tire Rubber Company, had been laid off in a bid to exempt them from
their retirement benefits. They filed separate suits to the District Court, which were later
consolidated and heard as one suit. In their claim, they stated that they had worked for the
company for 19 and 25 years, respectively. They were later recalled to work, but their employer
did not give them credit for purposes of calculating their retirement benefits.
The plaintiffs further added by the actions by their employer were motivated by malice
and were aimed at making sure they were no longer eligible for their retirement benefits. This
was therefore a violation of their labor rights contrary to sec 502 of the Employee Retirement
Income Security Act of 1974 (ERISA). The court in dismissing their claim stated that they were
time-barred by the Alabama Limitations of Actions Act, which provided for two years ...
