Question Description

Describe how the security guard and Denny's manager should have handled the situation in Lizardo v. Denny

Tutor Answer

School: University of Maryland

Considering there was an overcrowd restaurant, during after hours of bars closing, and  one security guard, management should have been prepared for these crowds. As we can see in the court summary, Denny's management and staff were not, resulting in the incident of potential discrimination by the patriots in question. The proper action/s would have been to notify law enforcement once the incident occurred, given the intoxicated nature of our suspects. Once Lizardo became loud, obnoxious, and disruptive to other customers, this was a clear indication that the incident was escalating. Obvious cues were to ensure adequate staffing to support the incoming crowds, read the behviroal displays of the crowd, and notify law enforcement when needed.
