within the professionally acknowledged standards. To avoid legal redress, nurses need a proper
understanding of the legal and professional risks within each medical situation, coupled with
adequate hospital initiatives to mitigate the risks. The current paper analyzes the existing legal
issues within the case, culminating in the provision of measures for the nurse and the hospital as
a whole to mitigate such issues.
Summary of Legal Issues
The nurse holds the responsibility of ensuring the clinical area of assignment meets the
skillset that they possess. In the current case, the nurse knowingly accepts an assignment within
an area that they feel incapable of handling comprehensively. There exists no evidence to
indicate that the nurse made necessary efforts to inform the in-charge nurse or request for
additional supervision. The failure of the nurse to raise concerns about the limited skills to
operate within the ICU amounts to malpractice as a result of failure to act within the required
