The debate between national security and citizens’ liberty is one hottest debate facing the
USA Patriot Act’s implementation. The proponents of this Act emphasized that the Patriot Act
was necessary for correcting the national government's failures. The primary objectives of
passing this Act was to improve the sharing of intelligence information with foreign law
enforcement agencies, bolster the gathering of anti-terrorism intelligence information and
increase the effectiveness in the implementation of the Foreign Intelligence Surveillance Act. As
this Act aimed at creating a global anti-terrorism network, it also imposed mandatory detention
and importation of non-US citizens associated with terrorism1. Although this Act has proved to
be a considerable measure in improving national security, critics say that it threatens civil
liberties. Although this law has prompted a hot debate between balancing national security and
liberty, it remains in place today. This essay creates a contextual and historical understanding of
the Patriot Act by analyzing how the Act factors into a debate between the U.S. anti-terrorism
and human rights concerns on liberty.
