Scenario: In the early 1990s, Stella Liebeck, 79, ordered a cup of coffee at McDonald’s. She accidentally spilled the coffee on her lap and suffered serious burns. She sued McDonald’s for negligence, among other things.

McDonald’s hot coffee case is globally known as one of the major landmark cases on
negligence. Negligence as defined is failure by a person to act in careful manner that a
reasonably prudent person would exercise in similar circumstances and therefore it falls under
harm caused by carelessness (Rylands v. Fletcher, 1866). In the case of Liebeck
