Competency 1: Examine criminal law and procedure

The two key areas of learning for this competency are criminal law and the criminal law
procedures. Criminal law is a system of laws that are concerned with punishing people who
commit crime. These are individuals that commit crimes like murder, man slaughter, rape,
money laundering, assault or other unlawful activities that are punishable by the state. To punish
the people who commit such crimes, laws were put in place to ensure that these people pay for
their crimes by facing the law. Criminal offenders are punished by the law in different ways.
There are those who get jail sentences (Scheb, & Scheb, 2011). The sentences vary depending on
the severity of the crimes. There are other times when a person can be sentenced to death while
petty offenders can be sentenced to community service, or fine depending on the severity of the
crime.

Before a judge gives a final ruling, there is a procedure that is followed that is stipulated
by the law. The procedure begins with the person committing a crime. The individuals is then
reported or surrenders to the authority where a criminal case is opened. The person is then taken
to court where a judge listens to the case and determines whether the person is guilty or not. If
not guilty, the person is set free (Scheb, & Scheb, 2011). If guilty, the person has a case to
