Racial Discrimination against African American in the system of Criminal Justice
Cultural discrimination defines the exclusion, restriction or hatred directed to a group of
individuals in a society on the basis of their cultural values and beliefs. It remains a social vice
that should not be existent in modern societies where human rights prevail. Cultural
discrimination, however, remains prevalent in the US. The state of cultural discrimination among
African Americans is made worse when that discrimination occurs in the body that is supposed
to fight against the existence of such vices in the society. This essay argues that cultural
discrimination is present within the criminal justice system, despite the many arguments that
might seem to disapprove this statement.
Cultural discernment or discrimination exists within the various elements of criminal
justice beginning with policing to the sentencing of individuals suspected of criminal offences.
The policing aspect of the criminal justice system included suspicion of criminal activities and
there is a clear indication of discriminatory policing. The war on drugs remains one of the major
crime for which racial disparity remains relatively clear. While the rates of engagement in
criminal activities related to the position, sales and even use of drugs is almost equal among the
different races, African Americans are really more likely to be suspected them whites (Provine,
50). African American comprise of 14% in the population but 37% of individuals arrested for
drug offenses are African Americans.
