Introduction
The legal and ethical issues around data privacy continue to generate immense interest
due to the increment of cases revolving around unauthorized access to various individuals
and entities. Like technology, laws are also dynamic, with societies changing the regulations
that govern them to suit their present. It is in that context that the American government,
through various legislative actions, has established several laws under the Freedom of
Information Act to govern issues around unauthorized information access. Forensic
investigators in the digital ad cyberspace world refer to individuals who, through an
exploration of hard disk and digital files analysis, seek to establish the manner of occurrence
of a security event and obtain an explanation for the unauthorized access of data and files
from a given digital device.
The case study involving Mr. Oliver indicates instances of data breaches to an
individual for financial gain. The case explores the relationship between forensics and law. It
focuses on the legal consequences that the individual who stole those photos face if
apprehended and seeks to establish how the case goes forward. The celebrity's choice to
engage D&B is a stop-gap measure arrived at due to uncertainty of what the person holding
the photos might do.
Nature of the Crime and Its Influence on the Investigation
In accessing Mr. Oliver's photos without consent from the celebrity, the culprit in this
case study is responsible for breaking at least one law contrary to the Information Act's
requirements. While accessing and publishing an individual's photo even on social media
does not qualify to be a crime, the intentions behind the act define whether or not it is a
crime. On the one hand, accessing private data to cause any form of harm to the owner entails

defamation, and if caught, the perpetrator may face a civil suit since the act constitutes a civil
offense. On the other hand, accessing private data to sell them for profit is a criminal offense
monikered copyrighting. As such, a perpetrator of such a crime stands trial in a criminal court

In Mr. Oliver's case, the photos are taken without his permission, and the individual
behind that actively seeks to sell them for profit without the celebrity's consent. Therefore, he
or she is committing piracy under the Copyright Act, and therefore, the investigation going
forward is treated as an investigation into a criminal matter. D&B, in proceeding with the
