Nooruddin Hanif and other individuals have been employees of the Respondent. Hanif
served as driver while the other individuals served in different capacities. The Respondent was
accused of failing to comply with Truth-in-leasing Regulations. He had also failed to comply
with the law by offering the complainants the correct wages and allowance as stipulated by the
New Jersey Workers’ compensation Law and the Wage payment Law. The employees had tried
to meet their employer in order to iron out the payment issue by they had not been given
audience by their employer. They then resorted to seeking help from the National Labor Relation
Board to seek justice for the act of right infringement by their employer.
There are also other issues that have been leveled against the Respondent. The
Respondent had been mentioned to have been involved in acts of interfering with the rights of
the employees. The Respondent was also mentioned to have attempted to restrain and coerce the
employees from striving to get their rights as enshrined in the Law in Section 7 of the Act in
violation of section 8(a)(1) of the Act. The Respondent’s unjust labor practices were serious and
attracted the involvement of the NLRB which will then take affirmative action meant to make
the policies of the Act to be effective.
After going through the evidence presented before it, the National Labor Relation Board
notes that the respondent had violated the right of the employees. The Respondent had been
found guilty of infringing the rights and privileges of the employees as well as making loss of
earnings and other benefits because of being victimized by their employer. In relation to the case,
the board decides that the Respondent should cease from threatening the employees by telling
them that their employment would be terminated in the condition that they do not stop
advocating for their rights.

The National Labor Relation Board also decided that the Respondent was forbidden
from discharging employees because of engaging in actions that were meant to protect them
from abuse from their employer. The board also made it clear that they would not allow the
Respondent to engage in acts aimed at coercing or interfering with the rights of the employees.
To effectuate the policies of the Act, the board to the affirmative action of ordering the
respondent to reinstate Hanif to his former job or if the job no longer exists he be given an
equivalent of the job previously held.
The above case relates with the course in several ways. One of the ways that this case
relates with the course is that it educates the Human Resource Manager about the rights that
employees are guaranteed by the Section 7 of the Act. Having this knowledge makes the
manager to be conscious about the decisions that they take. The Human Resource department is
the one department that deals with the firing and hiring of labor. It is therefore paramount to be
well equipped with the knowledge about the rights that employees are allowed to enjoy by the set
labor act.
Every employee has a guarantee of rights that are enshrined in the Act (Deakin, 2012).
Laws have been developed that help in dealing with the violators of those rights. The case above
relates with the course in the sense that it gives knowledge of the rights and how to tell when
those rights are being infringed by the employers. From this case on is able to identify the rights
and the way through which employers always try to suppress the actions of employees who try to
fight for those rights. Some of labor rights are violated in very innocent ways that are hardly
identifiable.
After considering all the factors and issues of the case, my personal position conforms to
the decision that was taken by the National Labor Relations Board. The decisions that have been

made by the board are in line with Section 7 of the Act that grant employees’ rights at their
workplaces. The Federal Law gives every employee the right to form, join or assist a union. It
also grants the employees with the right to advocate for better bargains or choose someone to
represent the in bargaining. In light to this case, I see the need to uphold the rights that
employees have been granted by the law.
