EXAMPLE: Jackson, a male in his 30s leaves the supermarket late one evening to observe several teens running grocery carts into the cars parked in the lot. He abandons his cart next to his car and approaches the youths, asking that they stop their behavior. They confront him and one pulls a knife. He tells them that he doesn't want any trouble, he just wants them to stop damaging vehicles with the shopping carts. They continue to threaten him and a scuffle ensues. Meanwhile, a supermarket employee has called the police. When they arrive, they find Jackson lying in the parking lot with several stab wounds on his chest and a welt rising over his left eye. He appears to have lost a fair amount of blood. He is having trouble breathing. He says he was kicked in the chest and in the groin. Is this an example of aggravated assault? Why or why not? I think this might be a borderline case. Aggravated assault is defined as injury which is likely to cause death, disfigurement, or permanent impairment of bodily function. Jackson's wounds are likely to heal and if he gets medical attention quickly he is likely to live. The welt on his face will go down and not leave a permanent mark. He could have scars on his chest which could move the case toward aggravated assault. A medical examination would need to be done to see if the stab wounds permanently damaged any internal organs. To get the proper justice for aggravated assault, Jackson will need a complete and accurate police report, a thorough, well-documented medical examination, and a good lawyer. 04-04-2014 Page 1 Example a.
