Abstract

In America, health care is becoming a significant political, social, economic, and
ethical concern. Every personal or professional area of life of an individual is impacted by
health care in one way or another. Based on United States Census Bureau (2010) about 255
million citizens were in some type of managed health care in the year 2009. Ethical standards
of this particular professional should be held as of high importance. This paper will discuss
some of the ethical dilemmas faced in the practice of mental health care. Policymakers have
shown concern over the potential legal and ethical ramifications presented by mental health
care practitioners to their consumers.

Each profession has its own ethical standards and mental health care providers are also
bound by their own set of ethical regulations that they have to adhere to. In America, each
state has laws that govern it and health care should follow the standards mandating by their
state’s regulation. However, ethical standards guiding health workers in their work conflict
from principles that govern the business aspect of the profession. The ways ethical and legal
issues are handled differ but the line is usually thin since some ethical violation could also be
deemed as violation of the law.
James, a community counselling student admits that he has no prior clinical
experience but he’s pleased. He goes on to accept supervision of a former acquaintance and
takes advantage of their relationship to avoid following the mandated procedures for his
