The Facebook situation which later led to the case of NLRB v. American Medical
Response which was not heard in the court but ended in a settlement helped determine
whether some policies were restrictive and limiting. The situation involved Dawn Marie
Souza whose job had been terminated due to some derogatory comments she had posted on
her Facebook about her supervisor. A complaint was made by the National Labour relations
Board against the American Medical Response (AMR) who later pled that the employee had
been terminated from her employment due to some serious complaints that were linked to her
behavior and not because of her description of her boss was in comparison to that of
psychiatric patient (O'Brien, 2014).
The labor board made their claim against AMR stating they practiced unfair labor
practices since the employee was wrongfully terminated and was denied access to union
representation. The labor board also stated that any criticisms posted in social networking
sites were under the “protected concerted activity” hence it is permissible for one to talk
about the terms and conditions of the company to another employee in public. Protected
concerted activity is defined as activities that employees may engage in with no fear of
employer retaliation.
The situation presented by Parexel International, LLC and Theresa Neuschafer is
quite different from the situation involving Dawn Marie Souza. Therese was a nurse who was
