Introduction

Sexual harassment is defined by the Equal Employment Opportunity Commission (EEOC)
as the non-consent sexual advances or conduct, the request for sexual favors and other verbal or
physical conduct of a sexual favor that interferes with a person’s work performance or creates a
hostile or offensive work environment (EEOC 2011). Some feminist scholars relate sexual
harassment to be within the broader patterns of discrimination, power, and privileges linked to
sexual based inequality (MacKinnon 1979).
Sexual harassment can range from persistent and offensive sexual related jokes to posting of
offensive material on the bulletin board and despite the myth that it is mainly towards women, men
are also victims. It is a form of sexual discrimination under Title VII of the Civil Rights Act of
1964 which provides that there are laws stipulated by the state and federal authorities that protect
employees from sexual harassment. There are two types of sexual harassment under the Title VII
namely;
i.

Quid pro quo
This refers to a form of harassment where a person in authority, mostly a supervisor, demands

that the subordinates have to tolerate sexual harassment as a condition of getting or keeping a job
or receiving a job benefit such as promotions and salary raises. This form of harassment can be in
terms of the supervisor asking for a simple kiss in order for the person to keep the job.
ii.

Hostile work environment
This serves as grounds for legal action when the harassment based on sex extends to become

persistent and severe to the point of creating an abusive or offensive working environment. In such
a situation the court can intervene to solve the issue....
