Management and Unions
Introduction
Employers are forbidden by the National Labor Relations Act from restraining,
interfering with and coercing the employees when it comes to the employees exercising their
rights relating to joining and assisting in improving the terms and conditions of employment.
Some employers threaten their employees that they will lose their jobs or some benefits if they
fail to concur with the set terms by the management. This is taken as violation of law by the
National Labor Relations Act. On the other hand, if the Labor organization threatens the
employees that they will end up losing their jobs failure to support the union is also regarded as
law violation by the National Labor Relations Act. This paper will discuss the three pieces of
legislation that have been critical in the definition of the management and unions rights. It will
also discuss the importance of the laws and the role they play in shaping the today’s relationship
between the management and unions (Utada, 2013).
There are three pieces of legislation that have been very critical in defining the rights of
unions and management. The first piece of legislation is known as the Sherman Antitrust Act.
Under this law, the unions’ strikes and boycotts are covered. Strikes occur when the employees
eventually stop working in order to pressure and make the company or its management to agree
for a consensus. When the workers eventually stop working, the company undergoes some loses
due to the fixed and overhead expenses that are incurred when there is no work in progress. This
act commands the unions to be able to call off any strike that happens. Failure for the unions to
call off strike, some injunctions are issued by the judges that pose serious penalties to all the
union members on strike if they do not call off the strike and boycotts.

The other piece of legislation is known as Wagner. This act was enacted in the year 1935.
It is also known as National Labor Relations Act that guarantees the rights of employees to do
some organization and also makes an outline for the management relations and labor unions.
Besides offering protection to workers, the act also provides the framework for bargaining. This
act was designed to make unions and their employees to come into agreements, consensus and
collective bargaining without strikes, boycotts and threats. The act is devoted to protect the
economy and business as well as workers. Therefore in short, this act prohibits the labor
practices which are unfair. Examples of those acts are things like, unions denying and refusing to
have a collective bargaining with the employees’ representatives, employees’ discrimination
with an intention of encouraging or discouraging them from supporting the labor organization
amongst others (Sharma, & Sharma, 2014).
The other piece of legislation is known as Taft- Hartley Act which was enacted by Robert
Taft. The main purpose of the act was to make the bargaining power between the union and
employer equal. Besides having all these acts, the unions are today pushing for placement of
other labor laws. The unions feel that the employers have violated the rules and regulations that
govern the rights of the employees by firing the sympathizers of the union and refusing to have a
collective bargaining in good faith after the workers join the unions. Employee Free Choice Act
is being pushed by the unions today which would make it simple for the workers who are
interested in joining unions. This law would also provide ...
