In the contemporary society, individuals are settling conflicts amongst themselves using
various approaches. Today people are no longer relying on courts or trials to settle disputes.
Approaches such as intervention and arbitration are utilized by people to avoid court
interventions (McIlwrath and Savage, 2010). However, although Mediation and arbitration are
conflict resolution techniques that do not require the intervention of the judicial system, they are
different. This paper attempts to describe the advantages and disadvantages of utilizing either of
the two methods and the qualifications of becoming a mediator or an arbitrator.
Mediation can be considered a beneficial and effective approach to conflict resolution
due to its advantages. The first advantage of this approach is that it allows parties to a conflict to
have the freedom of choice. The individuals to a conflict are allowed active involvement in the
resolution process. Therefore, the parties will accept the final ruling based on the mediator’s
analysis of the cause of dispute and recommended a solution.
Secondly, mediation is effective in cases where parties to a dispute wish to continue with
