It does not grant local government many rights in the bankruptcy proceeding. Nevertheless, in practice, the local government is an active participant, seeking to further the interests of the local economy. The reorganization process of the role of the local government is inefficient and directly conflicts with the goals of reorganization. Identify the problem The problem of the enterprise bankruptcy law of the people’s republic of china is that the role of the local government is inefficient. The country made efforts in their laws and regulations more unified, and consistent. The law was made to reduce the government's direct involvement in economic activities, but the government continues to actively intervene in the reorganization of listed companies in China. For example, all the reorganization of/against the listed companies cannot be accepted by the people's court unless the local government allows and officially approves the application. This is a problem because the government has no role in the performance of a company. The government role is to set rules and regulations for businesses to follow. That is their only job when it comes to the business world/ the economy. What the Chinese government was doing was sending fund to ST Canghua to ensure they reported a profit on their balance sheet. This is a problem because again it makes you wonder what ties does the government have to this company that they send millions of dollars jus to keep them open and running. This is not the role of the government, this company should of been out of business years ago. References Zhao, H. (2017). Reorganization of Listed Companies with Chinese Characteristics.
